A fairly common problem that comes with the advent of HDMI (High Definition Multimedia Interface) becoming the new industry standard for transmitting TV signals is how to select the correct length of HDMI cable. In the old days, when everything was carried on RG6 coax cable, it was possible to carry the signal over fairly long runs and then just cut the cable to length and fit a coax connector and just plug it into the TV. Although the RG6 cable is still used to connect your satellite dish to say, for example, a Freesat+ receiver, the output from the box to the TV will now invariably be an HDMI cable.

Another complicating factor is the popularity of hanging flat screen televisions on bare walls or over a fireplace. What makes selecting the correct lead length difficult is that it is not possible to simply extend or shorten the lead. In general, there is a good selection of HDMI cables ranging from 1m to 20m, with the upper limit being the level of signal loss that occurs with cables no longer than 20m.

No matter how well you plan it, there is always the possibility that the cable is too short. For example, the HDMI input on your new HDTV is in a different location than you expected, or you decide to mount the TV in a slightly different location. In school, the teacher told us that the difference between murder and manslaughter is that murder is when you kill someone intentionally while manslaughter is when you kill someone accidentally.

So if a drunk driver kills someone, is it murder or manslaughter?

What is the difference between someone deliberately driving a car into a crowd and someone being killed and someone else making an error in judgment, such as texting someone while driving, and getting into an accident as a result?

“intention.”

It is their intent that determines whether they have committed murder or manslaughter.

The dictionary describes intention like this: “If you intend to do something, you are determined to do it.”

There is no doubt that Jennifer never intended to kill the victim.

The bottom line is that Jennifer shouldn’t have been charged with first degree murder in the first place, but then sentencing her to life without parole is a sentence that rational thinking people would find inhumane.

Marriage is perhaps one of the most interesting ceremonies in our culture. Many of us plan for months so that everything turns out perfectly. Over the past 35 years, I have reviewed literally thousands of professional resumes. We regularly review the resumes of candidates and make decisions about which of these candidates will advance in the selection process for our client companies. When resumes are selected, they are quickly reviewed for relevance (approximately 30 seconds) and then passed on for further review. When you receive literally hundreds of resumes for a job position, you can imagine why we must be efficient yet selective as we move candidates through the recruitment process. That said, as a job seeker, you don’t have a lot of time to share irrelevant information on your resume because you’ll lose the hiring manager’s attention. There are three components to your resume that get the most attention from hiring managers. They should have top-of-the-page content, a value proposition statement, and include specific keywords. Law school essay exam answers that do not provide the explanatory information detailing step-by-step how each problem can be solved are said to be “conclusive.” That is, they recite conclusions without establishing a supporting analysis. Here is an example of a conclusive statement taken from a test answer: “Because Adam’s intent manifested the malice required for murder, he will be convicted.” The problem here is that, although the statement may be true, the writer has not told the reader (professor) precisely which of Adam’s acts show that he had the required malice to prove murder, what degree or variety of intentions the law deems sufficient to prove malice. nor what type or variety of malice is required to obtain a murder conviction.

The intent required to obtain a murder conviction is intent. Malice can be proven by showing that the accused intended to kill. The ability to conclude is not what “thinking like a lawyer” is about; rather, he is developing the ability to persuade another that the conclusion he has reached is supportable by applying the rules of law to a set of facts.

To score the most points on each topic, the essay must specify the topic, indicate which rule (or set of rules) a lawyer would use to solve the problem, articulate an analysis of how the facts of this hypothetical case are affected by the application of the rule, and the reason to a solid conclusion.

Legal analysis, in its most fundamental sense, boils down to an interweaving of the facts presented in the hypothetical, with the law it has identified. Try to weave each fact into the analysis as it is presented, rather than repeating or summarizing a series of facts and then commenting on them. The essence of the analysis section of an answer is this: an interweaving of the facts (presented in the question) with the law (the guiding legal rules, definitions, and principles used to resolve the legal issue identified by the issue). This interweaving is best accomplished by actually using “law words” and fact words in the same sentence or paragraph.

Here is an example of weaving together the law and the facts in one short paragraph:

The ‘half-done’ status of the job, along with the time (completion date now moves from the critical date from March 10 to May 10) and additional work would support the argument that performance scope was closer to minimum than full, however Jack would argue that his own costs of $50,000 demonstrate significant performance, which supports his position that the offense was only minor.”

The above “words of fact” are obvious (including Jack went hunting, the job was half finished, the date changed, etc.). The “words of the law” include: manifested its manifest intention, breached its obligation, scope of compliance, significant compliance, minor breach. It is this interweaving of law and fact that is used to show how facts prove the elements necessary to prove (or not) the position being argued for on the issue being considered.

Avoid writing conclusive answers or even conclusive sentences. You don’t get points on the law school essay exams!
